New Eviction Grounds from 2026
The new and modified possession grounds under the Renters' Rights Act. What landlords can use.

From May 2026, landlords can only evict using Section 8 grounds. Here are the main grounds that will apply.
Mandatory Grounds (Court Must Evict)
- Ground 1: Landlord wants to live in the property (4 months notice, can't use in first 12 months)
- Ground 1A: Landlord wants to sell the property (4 months notice)
- Ground 6: Major works or demolition (4 months notice)
- Ground 8: Serious rent arrears - 2+ months owed
Discretionary Grounds (Court Decides)
- Ground 10: Some rent arrears
- Ground 11: Persistent late payment
- Ground 12: Breach of tenancy agreement
- Ground 14: Antisocial behaviour
- Ground 17: False statement to obtain tenancy
Protections for Tenants
Even with these grounds, tenants have protections:
- Extended notice periods (up to 4 months for some grounds)
- Can't use landlord moving in/selling grounds in first 12 months
- Landlord must prove the ground genuinely applies
- For discretionary grounds, court considers if eviction is reasonable
